I. General Provisions

  1. This privacy policy defines how the personal data of users, necessary for the provision of the website www.oxpeckersolutions.com (hereinafter referred to as “Website”), are collected, processed, and stored.
  2. Personal data collected through the Website is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as “GDPR”), and the Act on the Protection of Personal Data of 10 May 2018.

III. Purpose of Collecting Personal Data

  1. The collection of personal data occurs in connection with the user’s use of the Website or other forms of remote communication with the Controller and may include:

   – data collected through the contact forms provided on the website, processed on the basis of the provision of Article 6(1)(b) of the RODO in order to perform contracts concluded with the user to whom the data refers or to take pre-contractual action with the user carried out at the request of that person.

   – data collected through the contact forms made available on the Website, processed on the basis of the provision of Article 6(1)(b) GDPR, until such time as the handling of the enquiry is completed, if no contract has been concluded as a result of the enquiry.

   – data collected automatically in connection with the user’s use of the Website – log data, processed on the basis of the provision of Article 6(1)(f) GDPR, for the purpose of the Controller’s own legitimate interests consisting of statistical activities and development work, for the period necessary for the purposes of their processing or until the user raises an effective objection to the processing of personal data in this regard.

   – data in the form of e-mail address provided by the user for the purposes of marketing activities.

   – cookies and other similar mechanisms in accordance with the Cookies Policy on the basis of Article 6(1)(f) GDPR.

  1. Providing data is voluntary but necessary for the conclusion of agreements or utilization of Website functionalities.

IV. Types of Processed Personal Data

The Controller may process users’ personal data, including: first name and last name, residential address, email address, phone number, other data provided by the user.

V. Duration of Personal Data Processing

  1. Personal data of users will be processed for the following durations:

       – When the basis for data processing is agreement performance – until the expiration of claims following its execution,

       – When the basis for data processing is consent – until its withdrawal, and post-withdrawal until the expiration of claims.

  2.  In both cases, the limitation period is 6 years, and for claims related to periodic benefits and claims associated with business activities – 3 years (unless a specific provision states otherwise).

VI. Sharing of Personal Data

  1. Personal data of users may be disclosed to: entities affiliated or cooperating with the Controller, its subcontractors, e.g. like Microsoft, through Microsoft Bookings, or others (e.g., providers of technology services to support the Website, providers of the Website maintenance services, providers of the Website security analysis services, law firms).
  2. In the event that any of our providers are based in a country outside the EEA, we make sure in each case that they provide adequate data security guarantees, as evidenced by the possession of the relevant certification, e.g. Privacy Shield (for US entities), which can be checked by clicking on the following link: https://www.privacyshield.gov/list or the Commission-approved Standard Contractual Clauses signed with us.
  3. Personal data of users can be transferred outside the European Economic Area (EEA).

VII. User Rights

  1. Users of the Website have the right to:

   – access their personal data and obtain a copy of them,

   – rectify their personal data, if it should turn out to be incomplete or incorrect,

   – erase them or restrict their processing,

   – transfer their personal data to another controller,

   – object to data processing,

   – withdraw consent at any time (without affecting the legality of processing based on consent prior to withdrawal).

  2. The Controller will fulfill or deny requests promptly – within a maximum of one month from their receipt.
  3. Users have the right to file a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa) if they believe that data processing infringes upon their rights and freedoms (GDPR).

VIII. Final Provisions

  1. The Controller reserves the right to amend the Privacy Policy, with user rights remaining unrestricted.
  2. Information about introduced changes will appear in the form of a communication available on the Website.
  3. Matters not addressed by this Privacy Policy are subject to GDPR provisions and Polish law.
